IHSAN SEBAGAI DASAR HAK ASASI MANUSIA YANG BERKEADABAN DALAM PEMIKIRAN NURCHOLIS MADJID

Abstract


Human Rights in contemporary discourse are often understood in a legal-formal and anthropocentric manner, resulting in a crisis of civility due to their detachment from ethical and spiritual foundations. An excessive emphasis on individual rights claims without a corresponding balance of moral obligations has the potential to produce individualistic human rights practices that are insufficiently grounded in holistic human values. This article aims to analyze and formulate the concept of Ihsan in Nurcholish Madjid's thought as an alternative philosophical foundation for the development of civil and dignified human rights. This study employs a qualitative approach, utilizing a literature review and a philosophical–hermeneutical analysis of Nurcholish Madjid’s principal works, as well as supporting literature on the philosophy of human rights and Islamic ethics. The findings indicate that Ihsan, understood as transcendental awareness of the presence of God (muraqabah), constitutes an ethical principle that integrally unites spiritual and social dimensions. From Nurcholish Madjid’s perspective, Ihsan not only transcends procedural justice but also encourages proactive, voluntary moral actions grounded in noble character (akhlaq). This paradigm is capable of bridging the dichotomy between rights and obligations and of reinforcing respect for human rights as both a moral responsibility and a form of social worship. Accordingly, the concept of Ihsan-based civil human rights offers a significant conceptual contribution to the development of a contextual, transformative human rights discourse rooted in Islamic spirituality, particularly within the Indonesian socio-cultural context
